   These Website Terms of Use and Disclaimer (Website Terms) govern your access to and use of any FlightScope-operated website that links to these Website Terms (the Site).

   Purchases of Products are governed by the Terms and Conditions of Sale.

   Subscription-based Services and Service Contracts (if applicable) are governed by the Subscription / Services Terms and/or the Service Contract terms presented at purchase.

   Capitalized terms used but not defined here have the meanings given in the Terms and Conditions of Sale.

2. Age and Eligibility

   1. Website Access

      The Website may be accessed by users of any age. However, certain features, services, or content may be restricted as described below.

   2. Accounts and Services

   If you create an Account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your Account. You agree to notify us promptly of any suspected unauthorized access.

   Where the Site allows you to submit or upload content (Content), you remain responsible for your Content and represent you have the rights necessary to provide it.

   You agree not to use the Site to:

   1. violate any law or third-party rights;

   2. attempt unauthorized access, interfere with security, or disrupt the Site or related systems;

   3. scrape, exfiltrate, reverse engineer, or misuse the Site beyond intended use; or

   4. upload malware or otherwise harmful code.

   We may remove Content or suspend/terminate access where we reasonably believe these Website Terms are violated.

FlightScope’s total liability for any claims relating to the Site will not exceed €100, unless you paid fees to FlightScope specifically for Site access or Services in the 12 months prior to the event giving rise to the claim, in which case liability will not exceed the amount actually paid by you to FlightScope for such access or Services during that period.

    Some jurisdictions do not allow certain limitations; in that case, limitations apply to the greatest extent permitted.

12. Termination

    We may suspend or terminate your access to the Site (and/or your Account) at any time if we reasonably believe you violated these Website Terms or used the Site unlawfully. Upon termination, your right to use the Site will cease.

13. Consumer Governing Law and Mandatory Rights

    If you access this Website as a Consumer, these Terms are governed by and construed in accordance with the laws of the European Union and the laws of the country in which you are habitually resident. Nothing in these Website Terms limits or excludes any mandatory consumer rights available to you under applicable EU or national law.

14. Business Customers Governing Law

    Where you access the Website as a Business Customer, these Website Terms shall be governed by the laws of Poland, excluding its conflict-of-laws rules.
