Returns and Refund Policy

Capitalized terms used but not defined in this document have the meanings given in the Terms and Conditions of Sale.

  1. Applicability

    1. This Returns and Refund Policy explains the procedures, conditions, and timelines for statutory withdrawal, voluntary returns, and refunds where applicable. EU Consumers may have a statutory right of withdrawal under applicable consumer law. In addition, FlightScope may offer a voluntary commercial return policy. This Policy must be read together with the Terms and Conditions of Sale.

    2. This Policy applies to returns after delivery. Cancellations before shipment are governed by the Terms and Conditions of Sale. Where an EU Consumer exercises a statutory right of withdrawal before shipment, that withdrawal will be handled in accordance with the EU Right of Withdrawal section of the Terms.

    3. Products purchased from other authorized distributors and resellers and not from the Site may have different return policies and procedures.

    4. The return policy and related procedures may vary for different countries and regions for legal and practical reasons.

  2. EU Statutory Right of Withdrawal — First 14 Days

    For statutory withdrawals by EU Consumers, FlightScope will refund the Product price and the standard outbound delivery cost, where applicable. Additional costs resulting from the Customer choosing a delivery method more expensive than the least expensive standard delivery option offered by FlightScope will not be refunded unless required by law.

  3. Voluntary 30-Day Returns

    Customer may return the Product after delivery in accordance with this voluntary return policy as follows:

    1. To qualify for a refund, Products must be returned within 30 days of delivery.

    2. Software licenses, digital content, feature activations, subscriptions, and service contracts are non-returnable and non-refundable under FlightScope’s voluntary return policy, except where required by applicable law or expressly stated at the time of purchase. EU statutory withdrawal rights for digital content, digital services, and service contracts are governed by the EU Right of Withdrawal section.

    3. For voluntary returns after the statutory withdrawal period, Customers must contact FlightScope Support at customercare@FlightScope.com to obtain a return authorization number before returning a Product. EU Consumers exercising the statutory right of withdrawal may use the withdrawal button, withdrawal form, or other stated withdrawal method described in the EU Right of Withdrawal section.

    4. Customers are responsible for return shipping costs. Customers are also responsible for correct documentation and procedures followed for cross-border shipping, if applicable. FlightScope does not accept responsibility for customs delays, additional charges, or administrative complications.

      For EU statutory withdrawals, the Consumer is responsible for the direct cost of returning the Products unless FlightScope has expressly agreed otherwise or applicable law requires otherwise.

    5. FlightScope will refund the purchase price of the returned Product and, where applicable, any original outbound shipping costs paid on the customer’s behalf for FlightScope-branded products.

      For statutory withdrawals by EU Consumers, FlightScope will refund the Product price and the standard outbound delivery cost, where applicable. Additional costs resulting from the Customer choosing a delivery method more expensive than the least expensive standard delivery option offered by FlightScope will not be refunded unless required by law.

    6. For voluntary returns of third-party products, including third-party simulator items, a 3% credit card transaction fee may be withheld from the refund amount. This deduction does not apply where prohibited by applicable law, including where a full statutory refund is required following a valid EU withdrawal.

    7. Refunds are processed using the original payment method. No refund will be issued until the returned Product has been received and inspected by FlightScope.

    8. Customer must return the Product in the same condition as on the date of purchase, undamaged and unused, in its original packaging, including all accessories and printed materials. FlightScope reserves the right to charge a 15% restocking fee or refuse to refund a Product that has not been returned in this condition. These condition requirements apply to voluntary returns. For EU statutory withdrawals, the Consumer may be responsible for any diminished value of the Products resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Products.

    9. Should a refund request be denied for a valid reason the Product will be returned to Customer as received at Customer’s cost.

    10. FlightScope will process refund claims without unreasonable delay. Refunds will not be paid if the returned items have not been received by FlightScope. Customer acknowledges and agrees that processing of a refund claim involves the physical return of the Product, the assessment of the returned Product, administrative steps, and banking transactions, which will take some time to complete.

    For EU statutory withdrawals, refunds will be made without undue delay and no later than 14 days from the date on which FlightScope is informed of the Consumer’s decision to withdraw, subject to FlightScope’s right to withhold reimbursement until the Products have been received back or the Consumer has supplied evidence of having sent them back, where applicable.
